Chairman Scott: AHP Ruling is a Victory for Workers, Consumers

WASHINGTON – Chairman Bobby Scott (VA-03) issued the following statement after a federal court partially invalidated the Trump administration’s rule expanding the reach of Association Health Plans (AHPs).

“Today’s ruling is an important victory for workers and consumers who would be harmed by the administration’s decision to expand the reach of association health plans. The Department of Labor’s final rule is one of numerous examples of this administration’s efforts to sabotage the Affordable Care Act (ACA) through executive action. 

“As the court noted in its decision, the AHP rule was intended and designed to skirt the patient protections in the ACA, and it achieves this goal by ignoring the language and purpose of both the ACA and the Employee Retirement Income Security Act (ERISA). 

“The American people have made clear their desire for the Trump administration to stop sabotaging the ACA and to faithfully execute the law. Unfortunately, the administration is continuing to use executive orders and the Courts to undermine or completely eliminate access to affordable care for Americans across the country."
